These are the Terms & Conditions upon which Colmar Estate and its related entities (ABN: 72 067 737 160) permits you to use this website. By using this website you agree to be bound by these Terms & Conditions, as modified by Colmar Estate from time to time. In these Terms & Conditions “we”, “our” and “us” means Colmar Estate of 790 Pinnacle Rd. Orange, NSW 2800, and “you” and “your” means you the customer.

These Terms & Conditions together with your order constitute the entire Contract between us and you for the supply of products. No other Terms & Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.

By purchasing products, you make an offer to us to make the product purchase based on these Terms & Conditions.

RESPONSIBLE SERVICE OF ALCOHOL

It is illegal for Colmar Estate (Liquor License LIQW824007384) to sell alcohol to anyone under the age of 18. By placing an order with us you confirm that you are at least 18 years of age. It is also an offence to obtain alcohol on behalf of a person under the age of 18 years.

If Colmar Estate suffers any damages or other losses as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who placed the order(s).

DISCLAIMER

The information and the material available or accessible in this website (“Information”) is provided by Colmar Estate in good faith. We have taken all reasonable care in ensuring that the Information is accurate and current at the time of publication. We do not however guarantee the accuracy, completeness or suitability for any particular purpose, of the Information.

PURCHASING

Colmar Estate attempts to describe all its products as accurately as possible. However, we do not warrant that product descriptions or other content of this site is complete, current or error-free.

DELIVERY

Once an order is received the wine is usually despatched from the vineyard in 1-3 working days. Delivery times will vary according to destination. Colmar Estate is not liable for delays in delivering your wine that are beyond our control. Nevertheless, please contact us on 0419 977 270 or contact@colmarestate.com.au if wine is not delivered in a timely fashion.

DAMAGED GOODS

Colmar Estate is not responsible for wines damaged during delivery. This is the responsibility of Australia Post or the relevant courier and any complaints should be taken up with those parties.

PRICING & GST

All prices are in Australian dollars and are inclusive of GST unless otherwise stated. Ordering is not permitted in other currencies.

REFUNDS & RETURNS

Colmar Estate has high standards of production. In the unlikely event that one of our wines appears to be faulty please email us on contact@colmarestate.com.au or phone us 0419 977 270. In relation to recent purchases, we will happily replace faulty wines or credit your order.

In relation to historic purchases, we will seek your assurance that wines perceived to be faulty have been stored appropriately. If a wine is indeed faulty, rather than in poor condition due to unsatisfactory storage, we will be able to confirm this through tasting a sample from our reserve stocks. In this case we will happily replace or substitute the wine, or credit your order.

Apart from fair dealing permitted by the Copyright Act 1968, visitors to this website are permitted to download and display any of the Information for private purposes only. Colmar Estate reserves the right to change these Terms & Conditions. All revisions will be published on the website. Any amendments to the Terms & Conditions will only apply from the date the revisions are published on the website.

INDEMNITY

You agree to indemnify Colmar Estate for any loss or damage suffered if you breach these Terms & Conditions.

AGREEMENT

Each use of this website is an acknowledgement that you have read and understood these Terms & Conditions and agree to be bound by them.
